BMP Human Engineering coaching engagements and the Executive Performance plugin.
These Terms govern your use of BMP Human Engineering ("we", "us", "BMP") services, including one-to-one coaching engagements, the diagnostic and rebuild process described on this site, and the Executive Performance plugin for ChatGPT and Codex (the "Plugin").
By using our services or installing the Plugin, you agree to these Terms. If you do not agree, do not use our services. If you are using the Plugin on behalf of an organisation, you confirm you have authority to bind that organisation.
The Plugin provides general performance coaching: training structure, nutrition structure, recovery habits, and progress tracking. It is not a medical service.
The Plugin does not diagnose, treat, cure, or prevent any disease or condition. It does not provide medical advice, and it is not a substitute for a licensed clinician, registered dietitian, physical therapist, or other regulated professional. Users with a medical condition, medication, injury or post-surgical needs, pregnancy, or a history of disordered eating are referred to appropriate professionals, and the Plugin does not generate programs for them.
The Plugin does not prescribe medication, supplements, or treatment, and it does not interpret clinical data. Do not use it to manage a condition.
We make no promise or guarantee of a specific outcome, result, or health benefit from coaching, from the Plugin, or from any engagement. Individual results vary and depend on your effort, adherence, health, and circumstances outside our control.
Any cost-of-delay or opportunity estimate produced by the Plugin is a model based on stated assumptions, not a guaranteed financial figure or a revenue promise.
Coaching engagements are contracted separately and paid for directly with us, outside the Plugin. The Plugin does not sell, subscribe, or take payment for anything, and completing a Plugin assessment or a Plugin request does not create a coaching engagement.
Engagement terms — scope, session count, fees, scheduling, and cancellation — are set out in the written agreement or invoice for that engagement. Where an engagement agreement conflicts with these Terms, the engagement agreement governs.
Coaching is inappropriate where a licensed clinician is required. You warrant that you are physically able to participate in any program we provide, and that you will seek medical clearance where appropriate. We are not liable for injury arising from a program you perform against medical advice, or for failure to disclose a relevant condition.
We retain all rights in the Plugin, our coaching methods, assessments, frameworks, and site content. These Terms grant you a limited, revocable, non-transferable licence to use the Plugin and our materials for your own internal or personal purposes. No other rights are granted.
The Plugin is designed to run inside third-party platforms, including ChatGPT and Codex, which are operated by others. Those platforms are governed by their own terms and privacy policies. We do not control them and are not responsible for their availability, behaviour, or content moderation decisions.
Where the Plugin presents third-party information, it does so as reference material and we do not warrant its accuracy, completeness, or fitness for a particular purpose. We are not liable for decisions you make in reliance on it.
Except as expressly stated, our services and the Plugin are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Plugin will be uninterrupted, error-free, or available at any particular time.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits, lost data, or business interruption, arising out of or related to your use of our services or the Plugin.
Our total aggregate liability arising out of or related to the Plugin will not exceed $100 USD. Our aggregate liability arising out of a paid coaching engagement will not exceed the fees you paid for that engagement in the twelve months preceding the claim.
You agree to indemnify and hold harmless BMP from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the Plugin or services in violation of these Terms, your breach of an engagement agreement, or your unlawful or negligent conduct.
You may stop using the Plugin at any time. We may suspend or terminate access if you breach these Terms, and we may discontinue the Plugin or any service on reasonable notice. On termination, stored personal data is deleted in accordance with the privacy policy.
We may update these Terms. Material changes are posted here with an updated effective date. Continuing to use the Plugin or our services after a change means you accept the updated Terms. If you do not accept them, stop using the services and contact us to close out any engagement.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Courts located in Miami-Dade County, Florida have exclusive jurisdiction. Before filing any formal proceeding, you agree to contact us and attempt to resolve the dispute directly.
These Terms, together with any engagement agreement and the Privacy Policy, are the entire agreement between you and BMP regarding the subject matter. If a provision is held unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our written consent.
